Act of 17 November 1994 amending the Civil Code and other legislation in connection with the incorporation of provisions concerning the contract to provide medical treatment, Stb. 1994, 837.

Entry into force: 1 April 1995 (Stb. 1994, 845).

 

This act incorporates into the Dutch Civil Code provisions concerning the contract to provide medical treatment. It aims to clarify and strengthen the legal position of patients while taking into account the responsibility of the care provider to act as a competent care provider.

Parts of this act also apply -mutatis mutandis- if in the pursuance of a medical occupation or enterprise medical actions are performed other than by virtue of a treatment contract (art. 464). The act provides room for the enactment of special legislation, where necessary.

Examples of special legislation are:

  • The Act of 29 October 1992, Stb. 669, last amended by the Act of 17 December 1997, Stb. 660, concerning special admissions to psychiatric hospitals (Wet BOPZ);
  • The Act of 21 April 1994, Stb. 475 jo 6 October 1999, Stb. 459, concerning roads and traffic (Wegenverkeerswet 1994) (compulsory blood-test ex art. 163).
